The agreement
These terms are a contract between you and Distilled Systems LLC, a Wyoming limited liability company ("Distilled", "we", "us"). By creating an account, accepting an invitation, or using the Service, you agree to them and to our Privacy Policy. If you accept for a company, you confirm you can bind it, and "you" means the company. You must be at least 18. If you do not agree, do not use the Service.
The Service
Distilled runs Android phones in the cloud and lets you drive them yourself or through an AI agent, using our console, REST API, MCP server and TypeScript SDK. It also provides hosted agent runs, an assistant, network exits for phones, app installation, and billing. We improve and change the Service over time, and we may add, change or remove features. We will give notice of a change that removes something you pay for.
Accounts, workspaces and keys
You sign in with your email address. A workspace holds phones, keys, members and a balance. Its owners decide who joins and what each member may do. Keep your sign-in codes and API keys secret: whoever holds a key can act in the workspace with its scopes, and you are responsible for everything done with your keys and by your members and agents. If you think a key is exposed, revoke it in the console and tell us at sales@distilled.cx.
Give us accurate information, and do not share an account across unrelated people or businesses.
Acceptable use
You may use the Service for lawful purposes. You may not use it, or let your agent use it, to:
- break the law, or help anyone else do so;
- make, store or share child sexual abuse material, or content that sexually exploits or endangers minors;
- commit fraud, steal accounts or credentials, or impersonate a person or organization to deceive others;
- fake engagement, such as selling or buying followers, likes, views or reviews, or manipulating rankings or trends;
- send spam or phishing, or run harassment, threats or hate campaigns;
- attack, probe or overload other people's systems, including denial-of-service attacks, or distribute malware;
- reach another customer's phone, data or keys, break out of a phone's environment, or interfere with how we run the Service;
- reverse engineer the Service or resell access to it without our written agreement, except where the law allows.
You are responsible for following the terms of the apps, websites and networks you use on a phone, and the laws that apply to what you do with them. We do not review what runs on your phones and do not promise that an app will accept being used from one. We may investigate suspected misuse, and may remove content or suspend access that breaks this section. Our Acceptable Use Policy sets out these rules in full and is part of these terms.
Your content
You keep everything you bring to the Service or create with it: apps, files, accounts, instructions, secrets and what your phones hold. You give us a license to host, copy, transmit and process it only as needed to run the Service for you and to meet our legal duties. You promise that you have the rights to use it, and that it and your use of the Service do not break the law or anyone else's rights.
AI agents and third parties
Agent runs and the assistant use AI models, which can be wrong and can act in ways you did not intend. You are responsible for what an agent does on your phones and with your keys, accounts and secrets, so give an agent only what it needs and review its work. We hold some actions that use a secret until a person confirms them, but that does not make an agent's actions ours.
The Service works with services we do not control, including apps, proxy and network providers, payment processors and model providers. We are not responsible for them, and their availability or changes may affect the Service.
Fees and payment
The Service is prepaid. You add to your workspace's balance, from $10 to $1,000 at a time, by card or by crypto, and we charge against it for the hours your phones run, for data past what each phone includes, and for agent use past what each running phone includes. Current prices are in the pricing section of distilled.cx. We may change prices on 30 days' notice, and a change does not affect what you have already used.
When a workspace's balance reaches zero, its phones are stopped. A phone that stays stopped for want of balance for 7 days is removed with its data. Keep your balance topped up, and export what you need before then.
Top-ups are not refundable, except where the law requires or where we agree in writing. If a card payment is refunded or disputed, we take back the credit it bought, and the balance may go negative until you top up. Prices exclude taxes, which you are responsible for, other than taxes on our income. We pay the processing fees on top-ups.
Suspension and ending
You can stop using the Service at any time, and an owner can delete a workspace once it holds no phones. We may suspend or end your access, immediately where needed, if you break these terms, if your use threatens the security or operation of the Service or other customers, if the law requires it, or if you do not pay. Where we reasonably can, we will tell you why and give you a chance to fix the problem first. When your access ends, your right to use the Service ends, the sections that by their nature continue will continue, and we will delete your content as our Privacy Policy describes.
Our rights
We and our licensors own the Service, including its software, designs and names. These terms give you a limited, revocable right to use it as described here, and nothing more. If you send us feedback, you let us use it without owing you anything.
No warranty
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Service will be uninterrupted or error-free, that a phone will pass the checks of any particular app, or that an agent will complete any task.
Limit of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, however caused. Our total liability for all claims about the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose and $100. These limits do not apply where the law does not allow them, and they do not limit liability that cannot be limited, such as for fraud.
Indemnity
You will defend and indemnify us against claims, losses and costs, including reasonable legal fees, that come from your content, your use of the Service, or your breach of these terms or the law. We will tell you of a claim promptly and let you control its defense, and you will not settle it in a way that binds us without our consent.
Governing law and disputes
These terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Any dispute about them or the Service will be brought only in the state or federal courts located in Wyoming, and you and we consent to those courts' jurisdiction. Before suing, each side will try in good faith to settle the matter by writing to the other for at least 30 days.
General
We may update these terms. We will post the new version here and change its date, and for a change that matters we will email workspace owners at least 14 days ahead. If you keep using the Service after a change takes effect, you accept it. These terms and the Privacy Policy are the whole agreement between us about the Service. If a part is unenforceable, the rest stays in force. You may not transfer your rights under these terms without our consent. We may transfer ours as part of a merger or sale. A failure to enforce a right is not a waiver of it. Neither side is liable for a delay caused by events beyond its reasonable control.
